O presente estudo visa a analisar a exposição da vulnerabilidade do trabalhador intermitente no contexto da emergência sanitária Covid-19. Para tanto, a partir da análise de dados estatísticos, serão examinados alguns aspectos da vivência laboral dos trabalhadores intermitentes que possibilitam verificar seu perfil e sua vulnerabilidade, mais ampla do que a dos demais trabalhadores empregados. Inserido na legislação com o intuito legal de formalizar a situação de trabalhadores que ficavam à margem de proteção jurídica, bem como diminuir os níveis de desemprego, o contrato de trabalho intermitente é aquele no qual a prestação de serviços, com subordinação, não é contínua, ocorrendo com alternância de períodos de prestação de serviços e de inatividade, determinados em horas, dias ou meses, independentemente do tipo de atividade. O presente estudo visa a analisar a exposição da vulnerabilidade do empregado e do empregador, exceto para os aeronautas, regidos por legislação própria. No entanto, a realidade tem revelado que a imprevisibilidade quanto à existência de jornada e de remuneração torna os trabalhadores intermitentes mais vulneráveis que os demais empregados, ainda que inseridos em um regime de vínculo de emprego. O contexto da emergência da Covid-19 descortina essa situação ao revelar a maior perda inicial de postos de trabalho justamente nas áreas ocupadas por tais trabalhadores.

This study aims to analyze the exposure of intermittent worker vulnerability in the context of the Covid-19 health emergency. For this purpose, from the analysis of statistical data, some aspects of the work experience of intermittent workers will be examined, which make it possible to verify their profile and their wider vulnerability than that of the other employed workers. Inserted in the legislation with the legal intention of formalizing the situation of workers who were on the margins of legal protection, as well as reducing unemployment levels, the intermittent employment contract is one in which the provision of services, with subordination, is not continuous, occurring with alternation of service provision and inactivity periods, determined in hours, days or months, regardless of the type of activity of the employee and the employer, except for the aeronauts, governed by their own legislation. However, the reality has revealed that the unpredictability regarding the existence of hours and remuneration makes intermittent workers more vulnerable than other employees, even if they are employed. The context of the emergence of Covid-19 reveals this situation by revealing the greatest initial loss of jobs precisely in the areas occupied by such workers.
