Esta pesquisa teve por objeto a análise da efetividade dos direitos fundamentais como característica
do estado democrático de direito. Assim, especificou-se o objetivo de investigar
os direitos fundamentais e sua relação com a democracia. Para alcançar tal enfoque, a
pesquisa foi dividida em três momentos: no primeiro, realizou-se uma análise dos direitos
fundamentais e sua relação com o Estado e a Constituição, na segunda etapa, estudou-se
a democracia em seus aspectos formais e substanciais, já na terceira fase, analisou-se a
efetividade dos direitos fundamentais como condição para uma realidade democrática. Considera-se,
portanto, diante do estudo realizado, que na atual fase do estado constitucional,
que enfatiza a força normativa da Constituição e a importância dos direitos fundamentais,
torna-se imprescindível buscar a efetividade desses aspectos por meio da concretização
dos direitos constitucionalmente reconhecidos. Nesse contexto é salutar a atuação do Estado
quanto ao cumprimento de sua função social, a fim de alcançar a efetividade desejada.
Quanto à metodologia, foi utilizada a base lógica indutiva.

The purpose of this research was to analyze the effectiveness of fundamental rights as a characteristic
of the democratic state of law. Thus, the objective of investigating
