Há quase vinte anos vem-se observando a progressiva importação da cegueira deliberada do Direito anglo-americano para o Direito brasileiro, sob o fundamento de sua compatibilidade com o instituto do dolo eventual. O presente artigo analisa a relação entre a cegueira deliberada e o dolo eventual, investigando essa alegada adequação, de modo a revelar o equívoco dos fundamentos dessa argumentação. Nesse sentido, o presente estudo adentra na investigação das origens da cegueira deliberada no Direito estrangeiro, para, então, passar a traçar uma crítica a seu transplante ao Direito brasileiro. O percurso teórico traçado nesse artigo objetiva demonstrar o equívoco de se recorrer à punição a título de dolo eventual para condutas praticadas fora dos moldes dolosos, mas em situação de cegueira deliberada.

For almost twenty years there has been a progressive importation of the willful blindness doctrine from the Anglo-American law to the Brazilian law, stating that it suits the dolus eventualis concept. This article analyses the relation between willful blindness and dolus eventualis, investigating the stated suitability and revealing the mistakes in that statement. In this sense, it studies the origins of willful blindness in the foreign juridical system and then approaches the importation to the Brazilian juridical system.The theoretical path in this article intends to demonstrate the mistake in appealing to the sanction of the dolus in order to punish conducts performed in the willful blindness state of mind.
