O objetivo científico deste artigo consiste em analisar a atuação da Defensoria Pública da União como custos vulnerabilis nas ações possessórias multitudinárias, para tal se realizou pesquisa empírica da atuação perante a Justiça Federal da 4ª Região. A intervenção como custos vulnerabilis ocorre em nome próprio, em favor dos seus interesses institucionais, qual seja, a defesa dos vulneráveis. A necessidade de espécie interventiva própria nos conflitos fundiários ocorre por diversas peculiaridades, tais como fatores socioeconômicos dos envolvidos e obstáculos enfrentados pelas partes no âmbito do Poder Judiciário. Partindo da análise de dados da Justiça Federal da 4ª Região, constatou-se que a atuação como custos vulnerabilis ainda está aquém do devido. Como suposição para a não atuação, apontou-se: desconhecimento do instituto do custos vulnerabilis e da figura do Defensor Regional de Direitos Humanos (cargo responsável pela atuação coletiva, com abrangência em todo o território do Estado). O ofício de Defensor Regional de Direitos Humanos deveria ampliar a abrangência territorial da Defensoria Pública da União, o que efetivamente não ocorreu na 4ª Região. No que concerne à metodologia, foi aplicada pesquisa bibliográfica no primeiro item e seus subitens, os demais estão alicerçados em bases de dados.
The scientific objective of this article is to analyze the role of the Federal Public Defender’s Office as custos vulnerabilis in multitudinous possessory actions. To this end, empirical research was carried out on its work before the Federal Court of the 4th Region. The intervention as custos vulnerabilis occurs in its own name, in favor of its institutional interests, namely the defense of the vulnerable. The need for its own kind of intervention in land conflicts arises because of various peculiarities, such as the socio-economic factors of those involved and the obstacles faced by the parties within the Judiciary. Based on an analysis of data from the Federal Court of the 4th Region, it was found that action as custos vulnerabilis still falls short of what is owed. As assumption for non-action, it was pointed out: lack of knowledge of the institute of custos vulnerabilis and of the figure of the Regional Human Rights Defender (a position responsible for collective action, covering the entire territory of the state). The position of Regional Human Rights Defender should broaden the territorial scope of the Federal Public Defender’s Office, which has not actually happened in the 4th Region. With regard to methodology, it is worth summarizing that bibliographical research was applied in item one and its sub-items, the others are based on databases.
