A pandemia por Covid-19 salienta a essencialidade do direito à moradia, garantia essencial no acesso a direitos humanos. Nesse momento, os impactos à renda da população, principalmente mais pobre, afeta fortemente sua dignidade e bem-estar, o que demonstra a atual fragilidade do sistema de proteção de direitos humanos e fundamentais, em especial o direito à moradia e à alimentação adequadas. Neste artigo, analisamos, a partir de revisão bibliográfica e análise de dados, como o direito à moradia revela-se enquanto direito humano autônomo em relação ao direito individual de propriedade, que ao garantir direitos sociais fundamentais assume relevante interesse social, apto a ensejar políticas públicas e atuação do Poder Judiciário específicas no momento de pandemia e pós pandemia. Concluímos que os liames na relação urbano-rural, no atual contexto, revelam conteúdo complexo do direito à moradia através de sua continuidade com o direito à terra e território, ao trabalho e à alimentação.

The Covid-19 pandemic highlights the essentiality of the right to housing, as an essential guarantee in access to human rights. In this moment, the impacts on the population's income, mainly the poorest, strongly affect their dignity and well-being, which demonstrates the current fragility of the system for the protection of human and fundamental rights, especially the right to housing and to adequate food. In this article, we analyze, from a bibliographic review and data analysis, how the right to housing is revealed as an autonomous human right in relation to the individual right of property, which, in guaranteeing fundamental social rights, assumes a relevant social interest, capable of giving rise to policies actions and specific actions of the Judiciary at the time of pandemic and post pandemic. We conclude that the links in the urban-rural relationship, in the current context, reveal complex content of the right to housing through its continuity with the right to land and territory, to work and to food.
