RESUMO A proposta desse artigo é abordar a Teoria Crítica dos Direitos Humanos por meio da teoria de Joaquín Herrera Flores e Boaventura de Sousa Santos, atrelada ao Novo Constitucionalismo Latino-Americano, com destaque ao instituto do Pluralismo Jurídico e, analisar a perspectiva dos Direitos Humanos no cenário intercultural, com o intuito de investigar a autonomia e a emancipação do sujeito na sociedade. Assim, busca-se demonstrar a necessidade urgente do abandono da Teoria Tradicional de construção dos Direitos Humanos para que o diálogo intercultural sob a égide do Pluralismo Jurídico comunitário auxilie na concepção crítica e inovadora dos Direitos Humanos. ABSTRACT The purpose of this article is to address the Critical Theory of Human Rights through the theory of Joaquin Herrera Flores and Boaventura de Sousa Santos, pegged to the New Constitutionalism Latin American, especially the institute of Legal Pluralism and analyze the perspective of Human Rights in intercultural scenario, in order to investigate the independence and emancipation of the subject in society. Thus, we seek to demonstrate the need for urgent abandonment of the traditional theory of the construction of Human Rights to intercultural dialogue under the auspices of the Community Legal Pluralism assist in designing critical and innovative Human Rights Keywords: Critical Theory; New Constitutionalism; Legal Pluralism.

RESUMEN El propósito de este artículo es abordar la Teoría Crítica de los Derechos Humanos a través de la teoría de Joaquín Herrera Flores y Boaventura de Sousa Santos, vinculado al nuevo constitucionalismo latinoamericano, especialmente al Instituto Pluralismo Legal y analizar la perspectiva de los Derechos escenario intercultural humana, con el fin de investigar la autonomía y la emancipación del sujeto en la sociedad. Por lo tanto, se trata de demostrar la necesidad urgente de abandono de la teoría tradicional de construcción de Derechos Humanos para el diálogo intercultural, bajo los auspicios de la Comunidad Pluralismo Legal ayudar en la concepción crítica e innovadora de los derechos humanos.
