O presente trabalho aborda aspectos relevantes para a compreensão do retrocesso de direitos no cenário neoliberal, impossibilitando assim, que o Estado cumpra seus objetivos fundamentais –com base na Constituição Federal –de promover a efetivação plena dos direitos fundamentais aos seus titulares. Neste contexto, a atuação do Estadoque se realiza através do Poder Legislativo e do Poder Executivo, acaba por sobrecarregar o Poder Judiciário em decorrência da omissão de ambos os poderes no cumprimento de seus devidos deveres, ocasionando assim, a judicialização dos direitos fundamentais
This paper deals with relevant aspects to understanding the retrocession of rights in the neoliberal scenario, making it impossible for the State to fulfill its fundamental objectives -based on the Federal Constitution -to promote the full realization ofthe fundamental rights of its holders. In this context, the State acting through the Legislative Power and the Executive Branch, ends up overloading the Judiciary Branch as a result of the omission of both powers in the fulfillment of their due duties, thus causing the judicialization of fundamental rights.
