O justo título é um espaço argumentativo, que visa a assegurar a calibragem do sistema jurídico, para, em atenção à justiça, serem oferecidas respostas diferentes das usuais. Propõe-se usar o justo título como etapa argumentativa anterior à aplicação das exceções legais à proibição de uso da prova ilícita.
The “justus titulus” has the function of ensuring the calibration of the legal system, so that different answers from the usual ones are offered to problems that present relevant and particular circumstances for the realization of justice. It is proposed to use the “justus titulus” as an argumentative stage prior to the application of exclusionary rule.
