The purpose of this work will attempt to detect the main philosophical influence that gave rise to labor law and social security in Argentina in the early twentieth century. The understanding will be structured on the basis of verification by means of discourse analysis, the hegemony of the "positive social philosophy" in the conceptions and justifications that built the beginnings of that right "special". In particular, look for a narrative linking the fundamental premises of the 'positive science', its influence on legal thought (in particular, the work of Leon Duguit) and, finally, the landing of "positive philosophy" in the ideas surrounding legislative treatment of the "social question", expressed in the draft Labour Code of 1904, presented by the Executive to the National Congress.

La propuesta de este trabajo será intentar detectar la principal influencia filosófica que dio origen al derecho del trabajo y de la seguridad social en Argentina a principios del siglo XX. La comprensión estará estructurada en base a la verificación, mediante el análisis del discurso, de la hegemonía de la “filosofía social positiva” en las concepciones y legitimaciones que edificaron los albores de ese derecho “especial”1. En particular, buscaremos vincular narrativamente las premisas fundamentales de la “ciencia positiva”, su influencia en el pensamiento jurídico (en particular, la obra de León Duguit) y, por último, el desembarco de la “filosofía positiva” en las ideas que rodearon al tratamiento legislativo de la llamada “cuestión social”, expresadas en el proyecto de Código de Trabajo del año 1904, presentado por el Poder Ejecutivo al Congreso de la Nación.
