LEGITIMAÇÃO DO PROVIMENTO JURISDICIONAL PELA EXAURIENTE FUNDAMENTAÇÃO RACIONAL À LUZ DO MODELO CONSTITUCIONAL DE PROCESSO

A fundamentação das decisões do juiz encontra amparo não apenas no altiplano mais elevado
da legislação (art.93, IX, CF/88) como em reiterados comportamentos do legislador infraconstitucional.
O artigo tem por objetivo demonstrar a suma importância da fundamentação da convicção final do
juiz no itinerário do processo, pois é o mecanismo que visa impedir decisões solipsista e arbitrárias.
Antagonicamente ao Estado Liberal de Direito e ao Estado Social de Direito, o Estado Democrático
de Direito pondera que as decisões são legítimas quando a fundamentação do magistrado expõe quais
elementos desenvolvidos no itinerário processual justifica o seu posicionamento, que deverá estar
respaldo no direito material. A tutela jurisdicional deve adequar-se às normatizações constitucionalizadas,
pois deve demonstrar que efetivamente resguardou os princípios do contraditório, da ampla defesa e da
isonomia, já que a participação das partes no processo é um dos suportes ao magistrado para a construção
de suas conclusões finais de forma justa. A deliberação do pronunciamento que põe termo ao processo
é formulada mediante análise dos elementos probatórios, atos de fala e sob a hermenêutica do direito.

Resumo Inglês:

The reasons for the decisions of the judge finds support not only the highest plateau of the
law (art.93, IX, CF/88) as repeated behavior in the legislature infra. The paper aims to demonstrate
the paramount importance of the grounds of conviction of the judge in the final route of the process
because it is the mechanism that seeks to prevent arbitrary decisions and solipsistic. Antagonistic to
the liberal state of law and social state of law, Democratic State considers that decisions are legitimate
when the reasoning of the magistrate which exposes elements developed in the procedural route justifies
its positioning, which should be backing the right equipment. The guardianship court must conform
to the norms constitutionalised therefore must demonstrate that effectively safeguard the principles of
adversarial proceedings, the legal defense of equality and, as participation isonomic of the parties is one
of the brackets to the magistrate for the construction of their conclusions Final fairly. The decision by
the statement that terminates the process is formulated by analyzing the evidence, speech acts and in the
hermeneutics of the law
