O presente estudo discute a aplicação da norma penal quanto ao crime de violação de direitos autorais no cenário virtual, o qual avança tecnologicamente de forma drástica, originando novos meios de acesso à informação e, assim, formas inéditas de se violar a propriedade intelectual. A fim de acompanhar tais mudanças, são necessárias novas interpretações da norma. Este estudo aborda a hermenêutica que envolve um dos núcleos da conduta típica do artigo 184 do Código Penal em sua forma qualificada, a qual traz à tona a figura do lucro indireto, ponto central do texto e que é analisado sob o prisma do atual contexto da web.

The present study discusses the application of the criminal law to the crime of copyright infringement in the virtual environment, which advances technologically drastically, generating new means of access to information and, thus, unprecedented ways of violating intellectual property. In order to accompany such changes, new interpretations of the regulation are required. This study deals with the hermeneutics that involves one of the cores of the typical conduct of article 184 of the Brazilian Criminal Code in its qualified form, which brings to the forefront the figure of indirect profit, central point of the text ,which is analyzed from the perspective of the current context of Web.
