No Estado Democrático de Direito, os instrumentos jurídicos de combate à corrupção administrativa buscam dissuadir e sancionar os agentes públicos que agem de forma corrupta, positivando instrumentos ou mecanismos de tutela da probidade administrativa. Inobstante a institucionalização dos instrumentos de combate à corrupção no sistema normativo, a forma como o Estado se organiza politicamente e como os órgãos públicos de repressão se articulam pode ser determinante para a sua eficácia. Tendo como referencial teórico o neorrepublicanismo, o presente artigo pretende verificar se o desenho político-administrativo do Estado brasileiro favorece a plena eficácia dos instrumentos de combate à corrupção e, em caso positivo, como eles poderão ser empregados para a elaboração e promoção de uma governança da ética pública.

In Democratic State, legal instruments to combat administrative corruption seek to dissuade and punish public agents who act in a corrupt manner, adopting instruments or mechanisms to protect administrative probity. In spite of the institutionalization of anti-corruption instruments in the normative system, the way in which the State organizes itself politically and how the public organs of repression articulate can be decisive for its effectiveness. Based on neo-republicanism, this article intends to verify if the political-administrative design of the Brazilian State favors the full effectiveness of the anti-corruption instruments and, if so, how they can be employed for the development and promotion of a governance of public ethics.
