Esse artigo visa analisar como as categorias de gênero e estereótipos operam no Código Penal e como estes opera para (re)produzir as categorias supracitadas. Para seguir na investigação, faz-se necessário apresentar o contexto histórico do Código Penal brasileiro. Editado durante o Iluminismo e as teorias de inferioridade da “raça” humana, que inclui a inferioridade das mulheres, segundo Greco (2012), em um cenário marcado pela caça às bruxas narradas por Federici (2015) que também reforçam a inferioridade e objetificação da mulher. Época em que se podem verificar os elementos de gênero delineados por Chauí (1985), entre outros autores, e materializados pelos estereótipos de Pereira (2002), que também reforçam questões da feminilidade como sendo inferioridade, passividade, entre outras. Logo, as questões de gênero, estereótipos, patriarcado em vigor no contexto da edição do Código Penal provavelmente influenciaram a sua construção na época e hoje continuam a operar através dele.
This article aims to analyze how gender categories and stereotypes operate in the Penal Code and how they operate to (re)produce the aforementioned categories. To continue the investigation, it is necessary to present the historical context of the Brazilian Penal Code. Edited during the Enlightenment and the theories of inferiority of the human “race”, which includes the inferiority of women, according to Greco (2012), in a scenario marked by the witch hunts narrated by Federici (2015) that also reinforce the inferiority and objectification of women. women. A period in which one can verify the elements of gender outlined by Chauí (1985), among other authors, and materialized by the stereotypes of Pereira (2002), which also reinforce issues of femininity such as inferiority, passivity, among others. Therefore, the issues of gender, stereotypes, patriarchy in force in the context of the edition of the Penal Code probably influenced its construction at the time and today continue to operate through it.
