Objetiva-se por meio desse estudo analisar o princípio da afetividade como instrumento de reconhecimento da multiparentalidade no ordenamento jurídico brasileiro, considerando os aspectos da autodeterminação e da dignidade da pessoa humana nas relações jurídicas familiares, bem como examinar a multiparentalidade na seara extrajudicial. Perpassa pelo estudo evolutivo do Direito de Família até o direito constitucional ao planejamento familiar, com a proposta de reflexão por um viés normativo (ordenamento jurídico) e histórico. Para tanto, utiliza-se o método dedutivo, mediante extração discursiva do conhecimento, partindo de premissas gerais aplicáveis às hipóteses concretas, adotando-se como técnicas de pesquisa a perspectiva descritiva e a exploratória, fundamentando-se em pesquisa doutrinária, legislativa e jurisprudencial, com a finalidade de demonstrar a relevância do tema apresentado em razão das consequências jurídicas advindas dos mais diversos modelos de constituição de família na contemporaneidade. Por fim, pôde-se concluir pela influência do princípio da afetividade no reconhecimento da multiparentalidade, tendo em vista que a proteção da pessoa humana por meio da constitucionalização civilista de sua dignidade, acompanhando a evolução axiológica da autodeterminação, fez com que o vínculo de filiação tivesse um viés de reconhecimento de busca da efetivação do princípio da dignidade da pessoa na sua realização pessoal.
The objective of this study is to analyze the principle of affectivity as an instrument of recognition of multiparenthood in the Brazilian legal system, considering the aspects of self-determination and human dignity in family legal relationships, as well as examining multiparenthood in the extrajudicial scope. It runs through the evolutionary study of Family Law to the constitutional right to family planning, with the proposal of reflection by a normative (legal order) and historical bias. To this end, the deductive method is used, through discursive extraction of knowledge, starting from general premises applicable to concrete hypotheses, adopting as research techniques the descriptive and exploratory perspectives, based on doctrinal, legislative and jurisprudential research, in order to demonstrate the relevance of the theme presented due to the legal consequences arising from the most diverse models of family con-stitution in contemporary times. Finally, it was possible to conclude by the influence of the principle of affectivity in the recognition of multiparenthood, considering that the protection of the human person through the civilist constitutionalization of their dignity, following the axiological evolution of self-de-termination, made the bond of filiation had a recognition bias of the search for the realization of the principle of the dignity of the person in their personal fulfillment.
