O presente artigo pretende investigar a extensão do conteúdo semântico atribuído à expressão “interesse comum na situação que constitua o fato gerador da obrigação principal” prevista no art. 124, inciso I, do CTN, segundo o entendimento jurisprudencial do STJ, entre os anos de 2009 e 2019. Para tanto, foram selecionados um total de 20 acórdãos, proferidos pelas Primeira e Segunda Turma, em julgamentos envolvendo, preponderantemente, casos de grupos econômicos de empresas.

The present article intends to investigate the extension of the semantic content attributed to the expression “common interest in the situation that constitutes the event generating the main obligation” foreseen in art. 124, item I, of the CTN, according to the jurisprudential view of the STJ, between the years of 2009 and 2019. In this context, a total of 20 judgments, pronounced by the First and Second Classes, were selected as object of study in judgments involving cases of economic groups of companies.
