O TOMBAMENTO DA CAATINGA COMO ATO HUMANITÁRIO-PROTETIVO À CULTURA NORDESTINA

A caatinga vem sendo vítima de uma forte investida destrutiva do homem: no intuito principal de produzir
energia, esta vegetação, especialmente nos últimos anos, vem sendo devastada, com índices mais
preocupantes que os da floresta amazônica, causando um desequilíbrio ecológico em toda a região do
semiárido, com reflexos na economia nacional. Entretanto, o principal malefício desta prática é a
descaracterização da identidade cultural do homem nordestino interiorano, quando lhe é retirada uma
parcela significativa do seu contexto onde foi criado e educado, qual seja, a macambira, o xique-xique, o
mandacaru, que tanto inspiraram produções humanas, assim no cinema, como na literatura, na música, no
artesanato. Destarte, para que se possa garantir uma efetiva proteção desta geografia, é proposta uma
nova interpretação pós-positivista dos institutos constitucionais e infraconstitucionais, a fim de que a
ferramenta do tombamento, seja de maneira administrativa, seja judicial ou legislativa, possa incluir a “mata
branca” nos seus laços protetivos, transformando em patrimônio cultural brasileiro este componente
essencial da cultura nordestina, para o bem do ator sertanejo e da cultura brasileira, assegurando o direito
fundamental do homem à sua produção cultural.

The “caatinga” has been the victim of a strong destructive onslaught of man: the primary purpose of
producing energy, this vegetation, especially in recent years, has been devastated, with rates of more
concern than the Amazon rainforest, causing an ecological imbalance in the whole region the semiarid, with
reflections on the national economy. However, the main evil of this practice is a distortion of the cultural
identity of the man northeastern backwoods, when it has withdrawn a significant portion of context where he
was raised and educated, that is, the macambira, xique-xique, mandacaru, which so inspired human
productions, both in film and in literature, music, crafts. Thus, so as to ensure an effective protection of this
geography, we propose a new post-positivist interpretation of constitutional institutions and infra, so that the
tool from tipping either way of administration, whether judicial or legislative, may include "white forest "in their
protective bond, making a Brazilian cultural heritage this essential component of northeastern culture for the
good of the actor and country music of Brazilian culture, ensuring the fundamental human right to its cultural
production.
