Com a evolução socioeconômica e o processo de globalização do mundo, observa-se a redução significativa das oportunidades de trabalho em diversos setores e o aumento expressivo da desigualdade social refletindo diretamente no aumento do fluxo migratório de indivíduos para diversos países. Além dos aludidos fatores, a eclosão de diversas guerras, as perseguições em razão do caráter racial, religioso, nacionalidade ou pertinência a um determinado grupo social e a grave e generalizada violação de direitos humanos verificadas em alguns países, são fatores determinantes para a necessidade do refúgio e ocasionam assim o aumento massivo e desordenado do número de refugiados. Diante dessa grave e generalizada crise mundial, foram instituídos diversos instrumentos normativos internacionais e nacionais ao longo do tempo com o escopo de garantir a proteção social dos refugiados. Porém, apesar dos diversos instrumentos protetivos já existentes, os refugiados estão desamparados no tocante à proteção social em decorrência, principalmente, da ausência de políticas públicas adequadas para possibilitar a aplicação dos instrumentos normativos positivados. Além disso, a ausência de sanções e punições severas no âmbito internacional e nacional ocasionam a facilitação ao descumprimento da legislação protetiva dos refugiados por alguns países. Daí surge a necessidade do debate constante entre a sociedade mundial e os órgãos de proteção dos refugiados no sentido de estabelecer políticas públicas capazes de efetivar a proteção social destinada aos refugiados, assegurando condições mínimas para uma existência digna, bem como estabelecer mecanismos capazes de solucionar a maior crise social deste século.

With the socioeconomic evolution and the globalization process of the world, there is a significant reduction of job opportunities in several sectors and the significant increase of social inequality, directly reflecting the increase in the migratory flow of individuals to different countries. In addition to the aforementioned factors, the outbreak of various wars, persecution due to racial, religious, national or social relevance or relevance to a particular social group, and the serious and widespread violation of human rights verified in some countries are determining factors for the need for refugees and thus lead to a massive and disorderly increase in the number of refugees. In the face of this serious and widespread global crisis, a number of international and national normative instruments have been established over time to ensure the social protection of refugees. However, in spite of the various protective instruments already in existence, refugees are abandoned in terms of social protection, mainly due to the absence of adequate public policies to enable the implementation of positive normative instruments. In addition, the absence of severe international and national sanctions and punishments facilitates the non-compliance of refugee protection legislation by some countries. Hence there is a need for a constant debate between world society and refugee protection bodies in order to establish public policies capable of effecting social protection for refugees, ensuring the minimum conditions for a decent existence, and establishing mechanisms capable of solving the problem. greatest social crisis of this century.
