Resumo Português:
O presente artigo trata dos princÃpios orientadores que auxiliaram no julgamento do caso Husayn vs.Polônia, dando subsÃdio à fundamentação de sua sentença. PrincÃpios orientadores que são encontrados na Convenção Europeia de Direitos Humanos nos artigos 1, 3, 5, 6, 8, 13, 38, 41 e nortearam as questões aqui analisadas. Questões que dizem respeito à responsabilidade do Estado (in casu, Polônia) pelo não cumprimento de obrigações pré-processuais – e.g. de investigação – e materiais – i.e. da não entrega extralegal (rendição extraordinária) de um indivÃduo a Estado terceiro ou órgão deste – além da consequente omissão em evitar o perigo concreto de violação a um dos direitos previstos na Convenção. Dizendo respeito, também, à s prerrogativas dadas à Câmara de Julgamento.
Resumo Inglês:
The present paper deals with the guiding principles that helped in the judgment of the Husayn vs. Poland case, giving subsidy to the basis of its sentence. Guiding principles that are found in the European Convention of Human Rights in arts. 1, 2, 3, 5, 6, 8, 13, 38, 41 and gave a north to the issues here analysed. Issues that concern with the responsibility of the State (in casu, Poland) for non-compliance with pre-procedural obligations – e.g. investigation – and material obligations – i.e. non extraordinary rendition from one individual to a third State or agency of this State – Besides the consequente failure to avoid the concrete danger of the violation of the rights under the Convention. Concerning also with the prerogatives given to the Trial Chamber.
