Este estudo fundamenta-se sobre o exame da nova teoria de aplicação dos direitos humanos, correlacionando-a ao âmbito do Direito do Trabalho. Isto é, discorre-se sobre a utilização da Eficácia Diagonal dos direitos fundamentais dentro da relação empregatícia, a fim de garantir os valores e os princípios apregoados na Constituição Federal. Nesse sentido, o presente trabalho objetiva expor argumentos histórico-sociais e jurídicos que consolidam a Eficácia Diagonal dos direitos humanos. Sendo assim, trata-se acerca da importância da utilidade da Eficácia Diagonal na contemporaneidade, com foco na análise do surgimento dos direitos humanos constitucionalizados, subdivididos em dimensões que serão, adiante, esmiuçadas, as quais simbolizam, sob o lema revolucionário égalité fraternité et liberté, importantes avanços à humanização e à dignificação do ser humano. Sob segundo viés, através deste artigo, analisa-se as espécies de Eficácias, Vertical e Horizontal, coexistentes, que embasam a consubstanciação da Eficácia Diagonal dos direitos fundamentais, a qual contempla proteção às relações da esfera privada que são marcadas pela desigualdade e pela hipossuficiência de uma das partes envolvidas. Por fim, objetiva-se a demonstração da essencialidade da aplicação da Eficácia Diagonal no Direito do Trabalho Brasileiro como um instrumento democrático assegurador dos princípios e dos valores constitucionais vigentes.
This study is based on the examination of the new theory of application of human rights, correlating it to the scope of labor law.That is, there is talk about the use of diagonal effectiveness of fundamental rights within the employment relationship, in order to guarantee the val-ues and principles proclaimed in the Federal Constitution. In this sense, the present work aims to expose historical-social and legal arguments that consolidate the Diagonal Efficacy of human rights.Thus, it is about the importance of the usefulness of Diagonal Efficacy in contemporary times, focusing on the analysis of the emergence of constitutionalized human rights, subdivided into dimensions that will be, in advance, scru-tinised, which symbolize, under the revolutionary motto égalité fraternité et liberté, advances in humanization and dignification of the human being. Under second bias, through this article, we analyze the species of Effica-cies, Vertical and Horizontal, coexisting,which underpin the substantia-tion of the Diagonal Effectiveness of fundamental rights, which includes protection of the relations of the private spheremarked by inequality and the hyposufficiency of one of the parties involved. Finally, the objective is to demonstrate the essentiality of the application of Diagonal Efficacy in Brazilian Labor Law democratic instrument for ensuring the principles and constitutional values in force.
