É possível identificar ao longo dos anos diferentes leituras das normas constitucionais que favorecem ou desfavorecem sua efetivação. Considerando o déficit deixado pelo projeto da modernidade, a questão central deste artigo é explicitar três possíveis leituras da Constituição do Brasil de 1988, com vistas à adequação aos ideais do Estado Democrático de Direito. Para tanto, objetiva-se analisar o modelo de Constituição programática; analisar a leitura constitucional que vê os princípios como mandados de otimização e por fim; analisar a Constituição tomada como transformação social, concepção compatível com a “leitura moral” da Constituição proposta por Ronald Dworkin. O artigo fará uma abordagem bibliográfica mediante uma metodologia analítica, utilizando-se, no último tópico, das reflexões teóricas da hermenêutica política de Ronald Dworkin. Conclui-se que a concepção de Constituição como transformação social tem uma importante contribuição na busca pela efetivação das normas constitucionais, uma vez que toma os princípios como sentido das normas e exige do intérprete uma justificação das decisões coerente com o conjunto dos valores expressos na Constituição, levando em consideração o direito como um todo.
It is possible to identify over the years different readings of the constitutional norms that favor or disfavor their effectiveness. Considering the deficit left by the modernity project, the central question of this research is to make explicit three possible readings of the 1988 Constitution, with a view to adapting to the ideals of the Democratic state. In order to do so, it aims to analyze the model of programmatic constitution; Analyze the constitutional reading that sees the principles as mandates of optimization and finally; Analyze the Constitution taken as social transformation, conception compatible with the "moral reading" of the Constitution proposed by Ronald Dworkin. The research will make a bibliographical approach through an analytical methodology, using, in the last topic, the theoretical reflections of the political hermeneutics of Ronald Dworkin. It is concluded that the conception of the Constitution as social transformation has an important contribution in the search for the effectiveness of the constitutional norms, to take the principles as a sense of the norms and to require of the interpreter a justification of the decisions coherent with the set of values expressed in the Constitution, considering the Law as a whole.
