Este artigo analisará o julgamento da Reclamação 36.476/SP, decidida pelo Superior Tribunal de Justiça (STJ) em 2020, em que o Tribunal adotou o entendimento de que não é cabível a reclamação para garantir a adequada aplicação de precedentes fixados pelo STJ a partir de julgamento de recursos especiais repetitivos. Neste diapasão, a partir de método dedutivo, com utilização de procedimento bibliográfico e documental, analisar-se-á o entendimento adotado pela Corte, em quatro partes: de início, realizar-se-á uma pequena introdução sobre o NCPC e as balizas fixadas por este no que toca à prestação jurisdicional; em seguida, analisar-se-á a visão tradicional dos chamados precedentes e como se inserem no contexto brasileiro e discorrer-se-á sobre a relação da reclamação com os referidos precedentes, com destaque à sua função de uniformização da prestação jurisdicional e, por fim, analisar-se-á a decisão do Superior Tribunal de Justiça, buscando responder se esta satisfaz a lógica de precedentes vinculantes. A investigação demonstrou que a Reclamação 36.476/SP desprestigia a lógica de precedentes vinculantes instituída pelo NCPC, isto porque retira instrumento apto a garantir a vinculatividade dos julgados que gozam de tal estatura o que, por si só, prejudica a unidade do sistema decisório.
This article will analyze the judgment of Complaint 36,476/SP, decided by the Superior Court of Justice (STJ) in 2020, in which the Court adopted the understanding that the claim is not appropriate to ensure the proper application of precedents set by the STJ from judgment of repetitive special features. In this tuning fork, using a deductive method, using a bibliographic and documentary procedure, the understanding adopted by the Court will be analyzed, in four parts: initially, there will be a small introduction about the NCPC and the fixed marks by this in what concerns the jurisdictional provision; then, the traditional view of the so-called precedents will be analyzed and how they fit into the Brazilian context, and the relationship of the claim with the aforementioned precedents will be discussed, with emphasis on their function of standardizing the jurisdictional provision and, by Finally, the decision of the Superior Court of Justice will be analyzed, seeking to answer whether it satisfies the logic of binding precedents. The investigation showed that Complaint 36.476/SP discredits the logic of binding precedents instituted by the NCPC, this because it removes an instrument able to guarantee the binding of judgments that enjoy such stature which, in itself, undermines the unity of the decision-making system.
