O presente trabalho aborda a violação de direitos das pessoas com deficiência, uma questão que persiste, independentemente de fronteiras culturais ou históricas, afetando essa população de diversas maneiras. Apesar da existência de legislações nacionais e internacionais de proteção, muitas dessas pessoas ainda enfrentam discriminação e exclusão, com falhas estatais em garantir sua segurança e direitos fundamentais. Nesse contexto, a Corte Interamericana de Direitos Humanos (Corte IDH) desempenha um papel crucial ao analisar e julgar casos de violações, estabelecendo padrões regionais que reafirmam a dignidade das pessoas com deficiência. O presente artigo tem como objetivo investigar a relação entre violência, direitos humanos e o papel da Corte IDH na promoção de um modelo de igualdade e não discriminação na América Latina. Em termos de metodologia, a pesquisa é realizada a partir da revisão crítico-reflexiva dos temas pautados e da utilização do método da fenomenologia hermenêutica. Dessa maneira, é possível verificar a importância que o Sistema Interamericano possui na efetiva proteção dos direitos das pessoas com deficiência, bem como na construção de um direito antidiscriminatório.
This work addresses the violation of the rights of people with disabi-lities, an issue that persists regardless of cultural or historical borders, affecting this population in different ways. Despite the existence of national and interna-tional protective legislation, many of these people still face discrimination and exclusion, with state failures to guarantee their safety and fundamental rights. In this context, the Inter-American Court of Human Rights (IACHR) plays a crucial role in analyzing and judging cases of violations, establishing regional standards that reaffirm the dignity of people with disabilities. This article aims to investigate the relationship between violence, human rights and role of the Inter-American Court in promoting a model of equality and non-discrimination in Latin America. In terms of methodology, the research is carried out based on a critical-reflective review of the topics discussed and the use of the hermeneutic phenomenology method. In this way, it is possible to verify the importance that the Inter-American System has in the effective protection of the rights of people with disabilities, as well as in the construction of anti-discrimination law.
