O presente artigo tem por objeto o estudo dos direitos fundamentais do imigrante ilegal no Brasil, bem como da possibilidade de acesso à justiça trabalhista. Primeiramente, buscou-se identificar alguns dos mais recentes fluxos migratórios com destino ao Brasil e as violações de direitos a que se submetem os imigrantes ao exercerem relação de trabalho no país. Em seguida, buscou-se identificar o tratamento outorgado pela Constituição Federal 158 DEFENSORIA PÚBLICA DA UNIÃO Escola Superior de 1988 aos imigrantes, bem como o que dispõe a Lei 6.815 de 1980, conhecida como Estatuto do Estrangeiro, e o tratamento legal dado ao imigrante em situação de irregularidade.
Posteriormente, analisou-se como se dá a lógica dos direitos fundamentais na Carta de 1988 e a aplicação destes ao imigrante ilegal. Por fim, foi feito estudo acerca do acesso à justiça trabalhista pelo imigrante em situação irregular, no que diz respeito à substituição processual por sindicato e à assistência judiciária gratuita, bem como em relação à aplicação da lei trabalhista no Brasil, tendo sido feita análise de julgados da Justiça do Trabalho.

This article is engaged in the study of the fundamental rights of the illegal immigrant in Brazil, as well as the possibility of access to labor justice. Firstly, it sought to identify some of the most recent migratory flows with destiny to Brazil and the violations of rights that are subject immigrants when pursuing employment relationship. Next, it sought to identify the treatment granted by the Federal Constitution of 1988 to the immigrants, as well as what the Law 6.815 from 1980 orders and the legal treatment given to the immigrant in irregular situation. Then, it analyzed how is the logic of the fundamental rights in the constitution and the application of those to the irregular immigrants. Lastly, study was made on the access to labor justice for undocumented immigrants, concerning to procedural substitution by union and free legal assistance, as well as the application of the employment law in Brazil, having been done analysis of decision from the Labor Justice.

El presente artículo se refiere al estudio de los derechos fundamentales del inmigrante ilegal en Brasil, así como de la posibilidad de acceso a la justicia laboral. En primer lugar, se intentó identificar algunos de los flujos migratorios más recientes con destino a Brasil y las violaciones de derechos a los que se someten los inmigrantes al ejercer relaciones laborales en el país. A continuación, se intentó identificar el trato concedido por la Constitución Federal de 1988 a los inmigrantes, así como lo que dispone la Ley 6.815 de 1980, conocida como Estatuto del Extranjero, y el trato legal dado al inmigrante en situación de irregularidad. Posteriormente, se examinó cómo se da la lógica de los derechos fundamentales en la Carta de 1988 y su aplicación al inmigrante ilegal. Por último, se realizó un estudio sobre el acceso a la justicia laboral por parte de los inmigrantes en situación irregular, en lo que se refiere a la sustitución procesal por sindicato y a la asistencia judicial gratuita, así como en lo que se refiere a la aplicación de la ley laborista en Brasil, y se hizo un análisis de los juzgados de la Justicia Laboral.
