O artigo em apreço analisa a representação do menor que está sob guarda unilateral no âmbito internacional e as suas normas protetivas no ordenamento jurídico brasileiro, propondo uma reflexão em relação à concorrência entre interesses fundamentais, bem como apresenta uma breve reverberação dos direitos humanos de proteção, observando-se a complexidade dos fenômenos de tutela dos direitos da criança. Por fim, examina a eficácia da proteção integral da criança no direito internacional e no cenário jurídico brasileiro.
Resumo Inglês:
The present article analyzes the representation of the child that is under unilateral guard in the international scope and its protective norms in the Brazilian legal system, proposing a reflection on the competition between fundamental interests, as well as presents a brief reverberation of the human rights of protection, observing the complexity of the phenomena of protection of the rights of the child. Finally, it examines the effectiveness of comprehensive child protection in international law and in the Brazilian legal environment.
