Nesse artigo, respeitando-se a Constituição Federal brasileira em seu inciso LXXVIII do artigo 5º, que assegura “a todos, no âmbito judicial e administrativo, são assegurados a razoável duração do processo e os meios que garantam a celeridade de sua tramitação”, discutimos os reflexos, no Direito e na Justiça brasileiros, de um déficit histórico de previsibilidade, certeza e segurança. Diante da falibilidade e a insuficiência do Estado/Juiz como mediador exclusivo do Direito para o alcance da Justiça, propomos a Inteligência Artificial como um “meio” alternativo, efetivo, seguro e eficaz para tratar paritariamente casos análogos com maior celeridade, acessibilidade material e previsibilidade aos processos, desafogando o sistema judiciário. O Direito e a Justiça, mediados pela Inteligência Artificial, garantiriam aos cidadãos amplo acesso aos Direitos e Garantias Fundamentais do Estado Democrático de Direito previstos na lei constitucional.
Resumo Inglês:
In this article, observing the Brazilian Federal Constitution, and especially its subsection LXXVII of Article 5, according to which “a reasonable length of proceedings and the means to guarantee their expeditious consideration are ensured to everyone, both in the judicial and administrative spheres”, we discuss a historical deficit of predictability, certainty, and security in the Brazilian Law and Justice. In light of the fallibility and insufficiency of the State/Judge as the Law’s exclusive mediator in the achievement of Justice, we propose Artificial Intelligence as an effective, safe, and efficacious alternative “mean” to treat analogous cases with parity and with more celerity, material accessibility, and predictability to the legal processes, thus unburdening the judiciary. Law and Justice, mediated by artificial intelligence, would grant citizens wide access to the Fundamental Rights and Safeguards ensured by the Constitution.
