O presente artigo trata da forma de contagem da duração dos contratos administrativos e a problemática envolvida quanto ao termo inicial/termo final. Analisa-se, para tanto, o correto momento para aditivação dos contratos continuados, avaliando a legislação aplicável ao caso. Aborda-se, ainda, a necessidade ou não de celebração de termo aditivo e a viabilidade de utilização do apostilamento para celebração da prorrogação de duração dos contratos administrativos. O artigo visou responder qual a regra de contagem dos contratos administrativos com prazos de duração fixados tanto em dia quanto em anos/meses.
Resumo Inglês:
This article deals with how the duration of administrative contracts is evaluated and the issue involved in the initial/final term. It will be analyzed the correct moment for the amendment of the continued contracts, evaluating the applicable legislation to the case. It will also be addressed whether it is necessary or not to make an addendum and the feasibility of using the apostilation to conclude the extension of the administrative contracts. The article will propose to answer what is the rule of counting of the administrative contracts with fixed terms of duration, both in days, as well as in years/months.
