A ANÁLISE AMBIENTAL LEGAL DE UMA BACIA HIDROGRÁFICA COM O RECURSO FOTOGRÁFICO: O CASO DO RIO BACACHERI EM CURITIBA - PR

Resumo Português:

O presente trabalho é uma pesquisa dos aspectos legais relacionados ao uso e
ocupação do solo, utilizando como estudo de caso a sub-bacia do Rio Bacacheri,
afluente do rio Atuba e pertencente à bacia do alto Iguaçu situada na região
nordeste da cidade de Curitiba-PR. Analisando alguns fatores relacionados às
condições atuais de uso e características físicas das áreas ocupadas pela bacia,
esta pesquisa elucida as incongruências promovidas às margens da bacia,
demonstrando incompatibilidades com a legislação nas esferas, federal, estadual e
municipal. Esta problemática é decorrente do acelerado processo de urbanização. O
incorreto uso do solo e conseqüente desrespeito a legislação, tem colocado em
cheque o poder fiscalizador estatal, destacando visivelmente o interesse econômico,
que predomina em detrimento a defesa ambiental. Para melhor entendimento dos
fenômenos o trabalho foi subsidiado com acervo fotográfico, o qual além de apontar
as temáticas ambientais, compara as condições atuais com parâmetros legais
vigentes.

Resumo Inglês:

This present project is a research of legal aspects related to the use and
occupation of the soil, using the case study the under basin of Bacacheri river,
secondary river from Atuba river and belong to the basin of Iguaçu river located at
the northeast region of Curitiba city – PR. Analyzing some factors related to the
current conditions of the use and physical characteristics of occupied areas by the
basin, the research intends to clarify the urban problems promoted at the side for
the basin, demonstrating incompatibility with the legislation of the spheres, federal,
state and municipal. This issue and consequent disrespect to the legislation, has
questioned the fiscalization power, standing out clearly the economic interest,
which predominate in damage the environmental defense. To have a better
understanding of the phenomena the project was helped with a great amont at
photographic material, with besides pointing the environmental thematic, enable to
compare the current conditions to some legal current edges.
