Resumo Português:

A pesquisa observa o transconstitucionalismo frente à efetividade da proteção do meio ambiente sadio e ecologicamente equilibrado, isto em razão da presente busca pelo desenvolvimento sustentável. O objetivo é analisar o fenômeno do transconstitucionalismo e seus reflexos na proteção ambiental, no desenvolvimento sustentável. Para alcançar tal enfoque, a pesquisa foi dividida em três momentos: crise ambiental; transconstitucionalismo entre ordens jurídicas; e o respaldo ambiental através do transconstitucionalismo. Conclui-se que o transconstitucionalismo é um mecanismo utilizado em ordem internacional, para o fim de aproveitamento das experiências de ordens jurídicas externas e pode ser usado em favor da preservação do meio ambiente e o desenvolvimento sustentável. Quanto à Metodologia, foi utilizada a base lógica Indutiva, além das Técnicas do Referente, da Categoria, do Conceito Operacional e da Pesquisa Bibliográfica.

The research notes the transconstituionalism against the protection effectiveness
of the healthy and ecologically balanced environment, seeking for a sustainable
development. The goal is the analysis of transconstitutionalism and the reflection
on environmental protection and on sustainable development. To achieve such an approach,
the research was dismembered into three stages: environmental crisis; transconstitutionalism
between legal systems; and the environmental support through transconstitutionalism.
The conclusion is that transconstitutionalism is a mechanism used
in international order, with the purpose of harnessing the experiences of foreign legal
systems and it can be used in favor of the preservation of the environment and sustainable
development. Regarding methodology, it was used the inductive rationale, beyond
of regarding the techniques, the category, operational concept and library research.
