Resumo Português:

O acesso à Justiça, sob o aspecto sociológico, pode ser entendido, acima de tudo, como
resultado de lutas travadas pelos mais diversos grupos sociais ao longo da história dos Estados
de Direito. Dentro desse contexto, surge toda uma crise da administração da Justiça, a partir
da explosão no número de demandas levadas aos órgãos estatais encarregados de prestar a
jurisdição, tudo isso contagiado a partir de uma busca incessante pelo aperfeiçoamento na
solução de litígios. As recentes transformações sociais traduzem o dilema relativo à qualidade
na prestação da justiça frente à crescente demanda jurídica. Os mecanismos de atuação da
sociedade servem como importante fator de aperfeiçoamento e na democratização do serviço
público jurisdicional. O interesse da sociologia diante dessa problemática consiste em buscar
meios de se alcançar o bem estar social, na medida em que analisa o fenômeno social do
acesso à justiça e a crescente movimentação do complexo aparelho estatal responsável pela
pacificação social.

Resumo Inglês:

The access to Justice, under the sociological aspect, can be understood, above all, as resulted
of fights stopped for the most diverse social groups throughout the history of the Rules of law.
Inside of this context, all appears a crisis of the administration of Justice, from the explosion
in the number of demands taken to the state agencies in charge giving the jurisdiction,
everything this infected from an incessant search for the perfectioning in the solution of
litigations. The recent social transformations translate the relative quandary to the quality in
the installment of justice front to the increasing legal demand. The mechanisms of
performance of the society serve as important factor of perfectioning and in the
democratization of the jurisdictional public service. The interest of the sociology ahead of this
problematic one consists of searching ways of if reaching the welfare state, in the measure
where it analyzes the social phenomenon of the access to justice and the increasing movement
of the complex responsible state device for the social pacification.
