A partir de alguns apontamentos sobre direitos fundamentais, levantam-se algumas questões a eles atinentes que parecem não haver sido bem consideradas, abrindo caminho para algumas discussões a serem apontadas. Comentam-se as gerações e os destinatários dos direitos fundamentais e a imprecisão linguística do legislador em relação a deixar claro o que sejam direitos e o que sejam garantias fundamentais. Apontam-se as gerações de direitos fundamentais como não só um reconhecimento dos anseios sociais mas também como um reflexo da evolução sociopsicológica do homem na história; os destinatários dos direitos fundamentais como fruto da produção jurisprudencial em razão da imprecisão da linguagem posta pelo legislador quanto a eles; e a imprecisão linguística do legislador constituinte que deixou de cumprir seu dever de bem declarar o direito, ao usar indevidamente conceitos relativos a direitos e garantias, refletido em um uso vocabular inadequado a expressar o que de fato são uns e outros.

This article aims from some notes on fundamental rights to raise some issues attached to them that seem not to have been well considered, paving the way for some discussions raising. The notes are about the generations and the adressees of fundamental rights and about linguistic imprecision of the legislature in relation to say precisely what are rights and what are fundamental safeguards. The generations of fundamental rights are described not only as a recognition of social concerns but also as a reflection of social and psychological evolution of man in history; also the adressees of the fundamental rights as a result of jurisprudencial production linked to the imprecision of language placed by the legislature to them, and the linguistic vagueness of the constituent legislator who layed aside their duty to declare clearly and by usind improperly the concepts to rights and guarantees, which is reflected by an inappropriate use of vocabulary to express what they really are each other.
