ASPECTOS GERAIS DA PROTEÇÃO AMBIENTAL NO BRASIL E NOS ESTADOS UNIDOS: A MULTA AMBIENTAL COMO INSTRUMENTO DE DEFESA DO AMBIENTE ECOLOGICAMENTE EQUILIBRADO

O objetivo do presente artigo é delinear um estudo comparativo sobre os aspectos gerais da proteção ambiental nos Estados Unidos e no Brasil, a fim de permitir a identificação da legislação, dos órgãos e dos procedimentos administrativos, aptos a exercer o poder de polícia ambiental e aplicar a multa ambiental. Para tanto, perpassa-se pela ideia de que o Estado, além de ser Democrático, Social e de Direito, deve incluir a proteção ambiental como objetivo fundamental do Estado, perfazendo-se o Estado de Direito Ambiental. No Brasil, com o objetivo de proteger e preservar o ambiente, a Constituição Federal de 1988, impõe ao poder público e à coletividade o “dever de defendê-lo e preservá-lo para as presentes e futuras gerações”. Neste sentido, o Estado detém atribuições fundamentais, dentre elas, o poder de polícia ambiental, que se reflete tanto na prevenção de atividades lesivas ao ambiente, como na sua repressão, quando do cometimento de dano ao ambiente. Nos Estados Unidos, sem abandonar os princípios do common law, o advento das questões ambientais ensejou o crescimento do direito legislado, adotando um sistema híbrido, disponível a todos cidadãos, para a solução judicial de prejuízos ambientais. Em ambos os países, dentre as sanções disponíveis destaca-se a multa ambiental, apresentada como um instrumento de caráter preventivo e reparatório, em defesa do ambiente ecologicamente equilibrado. Adotou-se o método hipotético-dedutivo, utilizando-se sob o ponto de vista dos procedimentos técnicos, a pesquisa bibliográfica, a partir de materiais nacionais e estrangeiros.

The purpose of this article is to outline a comparative study of the
general aspects of environmental protection in the United States and Brazil to permit
the identification of the legislation, the organs and the administrative procedures, able to
exercise the power of environmental police and implement environmental fine. Therefore,
it permeates by the idea that the state, as well as being democratic and social, must include environmental protection as a fundamental objective of the State, making up the
State Environmental Law. In Brazil, in order to protect and preserve the environment, the
Federal Constitution of 1988 requires the government and society the “duty to defend it and
preserve it for present and future generations.” In this regard, the State holds basic tasks,
among them, the power of environmental police, which is reflected both in prevention
activities of the harmful to the environment, and in their repression. In United States of
America, without giving up the principles of common law, the advent of environmental
issues gave rise the growth of statutory law, adopting a hybrid system, available to all
citizens for the judicial settlement of environmental damage. In both countries, among the
available sanctions it is highlighted the environmental fine, presented as a preventative
and reparative character instrument, in defense of ecologically balanced environment.
It was adopted the hypothetical-deductive method, from the point of view of technical
procedures and bibliographical research, from national and foreign materials.
