O Brasil está inovando na atividade polÃtica por meio dos protestos públicos, no qual multidões de pessoas tomam ruas e prédios, demandando questões ao Estado e à própria sociedade. Este fenômeno, ainda não está explicado suficientemente pelos pesquisadores. Estes protestos são legitimados pelo sistema constitucional como expressão do pluralismo polÃtico do Estado Democrático de Direito, contudo nem sempre são pacÃficos. Quando estes movimentos descambam para a violência e com incidentes gravosos contra pessoas e bens públicos e privados, questiona-se, quem responde juridicamente por esses danos? O Estado, a sociedade, a entidade responsável pelo evento ou individualmente cada agente causador do dano? Essas questões serão analisadas a luz das teorias da responsabilidade do Estado no regime constitucional vigente, pois a fundamentação depende da análise histórica dos institutos jurÃdicos e das práticas que envolvem esses fatos. Diante desse complexo problema polÃtico-jurÃdico, até onde o Estado é responsável diante dos incidentes gravosos, quais as atenuante ou exclusões na sua obrigação de indenizar. Tudo indica que a solução mais adequada juridicamente ainda está na análise e na interpretação do caso concreto.

Brazil is innovating in the political activity through public protests, in which crowds of people take the streets and buildings, demanding questions to the State and to society itself. This phenomenon is not sufficiently explained by the researchers. These protests are legitimized by the constitutional system as an expression of political pluralism of law democratic state, yet are not always peaceful. When these movements slide into violence and grievous incidents against people and public and private property, it questions, who answers legally for such damage? The state, society, the entity responsible for the event or individually each agent causing the damage? These issues will be analyzed in light of the theories of State responsibility in the current constitutional regime, as the foundation depends on the historical analysis of legal institutions and practices involving these facts. Given this complex political-legal problem, as far as the state is responsible to the grievous incidents, which extenuating or exclusions in their obligation to indemnify. It seems that the best solution is still legally in the analysis and interpretation of the case.
