Objetiva-se demonstrar ao leitor, a partir da análise empírica da jurisprudência pátria e internacional, bem como mediante o uso de doutrina especializada, a importância da aproximação dos dispositivos legais ao interesse público primário. Observa-se a criação, no decorrer da história, de diversos mecanismos legais e extralegais cuja finalidade é fazer o ordenamento jurídico atingir ao fim social almejado, tais como a mutação constitucional, o processo de inconstitucionalização de lei e as decisões manipulativas. Conclui-se pelo papel preponderante do Poder Judiciário da aproximação da norma aos anseios sociais, demonstrando que ele não detém apenas um papel de aplicador do Direito, nem tão somente de intérprete da lei, mas de verdadeiro agente legitimador em um Estado Democrático de Direito.
Resumo Inglês:
The aim is to demonstrate to the reader, from the empirical analysis of national and international jurisprudence, as well as through the use of specialized doctrine, the importance of bringing legal provisions closer to the primary public interest. It is observed the creation, throughout history, of several legal and extralegal mechanisms whose purpose is to make the legal system achieve the desired social purpose, such as constitutional mutation, the process of unconstitutionalization of the law and manipulative decisions. It is concluded that the Judiciary Power has a preponderant role in the approximation of the norm to social concerns, demonstrating that it does not only have the role of applying the Law, nor just interpreting the law, but as a true legitimizing agent in a Democratic State of Law.
