O presente artigo busca promover uma reflexão comparativa entre as ocupações do profissional arquivista e do Encarregado pelo Tratamento de Dados Pessoais/Data Protection Officer (DPO) no Brasil, ambos atuantes na área de privacidade e proteção de dados pessoais. Trata-se de um estudo qualitativo e exploratório, que analisa a Lei n. 6.546/1978, a Resolução CD/ANPD n. 18/2024 e outros normativos relevantes. Objetiva-se a partir dessa análise identificar convergências e similaridades entre as atribuições e competências do encarregado pelo tratamento de dados e do arquivista. Concluiu-se a existência de convergências e semelhanças nas duas funções, contribuindo de forma efetiva para a garantia do direito fundamental de proteção de dados aos titulares de dados e também cidadãos.
This article aims to promote a comparative reflection between the occupations of an archivist and a Data Protection Officer (DPO) in Brazil, both working in the field of privacy and personal data protection. It is a qualitative and exploratory study that analyzes Law No. 6,546/1978, Resolution CD/ANPD No. 18/2024, and other relevant regulations. The objective is to identify convergences and similarities, exploring possible intersections between the duties and competencies of the data protection officer and the archivist. It was concluded that there are convergences and similarities in both functions, contributing effectively to guaranteeing the fundamental right to data protection for data subjects and citizens.
