O objetivo do presente artigo é analisar a autonomia das pessoas com transtornos mentais, em uma perspectiva médica e jurídica, por meio de revisão bibliográfica. Destaca-se que as referências apresentadas pela literatura foram coletadas nas bases de dados PubMed e SciELO. A partir do contributo interdisciplinar, levando em consideração as legislações internas e internacionais, conclui-se que se deve garantir o direito da pessoa com transtornos mentais de participar efetivamente na tomada de decisão que lhe diga respeito. Além disso, é fundamental que o Estado garanta políticas públicas eficazes na tutela da pessoa com deficiência.
Resumo Inglês:
The objective of this paper is to analyze the autonomy of people with mental disorders, from a medical and legal perspective, through literature review. It is noteworthy that the references presented in the literature were collected in the PubMed and SciELO databases. From the interdisciplinary contribution, taking into consideration the domestic and international laws, it is concluded that the right of the person with mental disorders should be effectively participated in the decision making that concerns him. Also, the state must guarantee effective public policies to protect the disabled.
