Este artigo trata da condição sócio-econômica do idoso ou do deficiente que pretender receber o benefício assistencial no direito brasileiro. Relata as diferentes e algumas vezes conflitantes posições adotadas por diversas instâncias da Justiça brasileira no enfrentamento da questão. Busca na sociologia jurídica novos ares e melhores argumentos acerca do tema. Noticia que o assunto acaba de voltar à pauta do Supremo Tribunal Federal em paradigmático julgamento.

This article discusses the socioeconomic status of the elderly or disabled who wants to receive
the welfare benefit under Brazilian Law. It reports the different and sometimes conflicting
positions taken by various levels of the Brazilian courts to face the issue. It searches in legal
sociology news positions and better arguments on the subject. It relates the matter has just
returned to the agenda of the Supreme Court in a paradigmatic judgment.
