CARL SCHMITT: O JURISTA E SUAS CONTRADIÇÕES

O presente artigo tem como objetivo a exposição da vida intelectual do publicista alemão Carl Schmitt para a identificação de possíveis contradições nas suas diversas escolhas acadêmicas e políticas, bem como os motivos que poderiam ter levado o jurista a posições cambiantes na sua trajetória. Na sequência, detalhamos o perfil geral do pensamento de Schmitt antes e depois de se tornar um pensador reacionário, e de apoiar e se filiar a partidos conservadores da Alemanha de Hitler a partir dos anos 1930. Depois, analisamos o posicionamento de Carl Schmitt no momento pós-guerra, quando foi preso duas vezes e obrigado a depor diante do Tribunal de Nuremberg. Por fim, acentuamos a importância do seu legado intelectual como destacado especialista em Direito Público e a influência, até os dias de hoje, de suas obras.

The present article aims at exposing the intellectual life of the German publicist Carl Schmitt to identify possible contradictions in his various academic and political choices, as well as the reasons that could have led the jurist to changing positions in his career. In the sequence, we detail the general profile of Schmitt's thinking before and after he became a reactionary thinker, and of supporting and joining Hitler's conservative parties in Germany from the 1930s. We then analyzed Carl Schmitt's position at the time Post-war, when he was arrested twice and forced to testify before the Nuremberg Court. Finally, we emphasize the importance of his intellectual legacy as a leading specialist in Public Law and the influence, up to now, of his works.
