A banalização do conflito de competência da Lei 11.671/2008 e a jurisprudência formada por meio dos julgamentos desses incidentes contribuíram para a permanência indefinida de alguns presos em penitenciária federal de segurança supermáxima. O sofrimento decorrente dessa submissão acirra a crise no ambiente prisional, tornando-o mais propício a reações criminosas e recrudesce, assim, um novo ciclo de violações com consequências impensáveis. Este trabalho tem por objetivo discutir essa configuração do sistema e suas contradições, tendo em vista as violações de direitos a que dão margem. Para isso, lança mão de elementos disponíveis em documentos oficiais e também alguns registros de experiência de campo, além de bibliografia disponível sobre o tema. O desenho animado Caverna do Dragão (Marvel Productions, TSR e Toei Animation, 1983-1985) aqui é utilizado como alegoria para ilustrar a fracassada jornada dessas pessoas em sair do regime federal que deveria ser provisório e excepcional. A lógica aparentemente paradoxal do sistema se afina com uma tendência crescente ao punitivismo, revelando-se como uma máxima expressão do direito penal do inimigo no Estado brasileiro.
The trivialization of the competence conflict of the Law 11.671/2008 and the jurisprudence emanating from the adjudication of through these incidents has been decisive to some prisoners’ indefinite stay in maximum security federal prisons. The suffering arising from such submission to a permanent regime that violates human rights increases priso- ners’ indignation and aggravates the crisis within the prison environment, making it more prone to criminal reactions. To identify violations of the law, this work aims to discuss this configuration and its contradictions based on official documents, field experience, and theoretical references on the theme. The failed journey of these people, whose stay within the federal regime should be temporary and exceptional, is illustrated based on the allegory of the Dungeons and Dragons cartoon (Marvel Productions, TSR and Toei Animation, 1983-1985). The paradoxical logic of the system is in tune with the incre- asing punitivism, revealing itself as the maximum expression of the criminal law of the enemy in the Brazilian State.
