O presente estudo tem como objetivo analisar as medidas legislativas do Governo Federal e sua devida eficácia para preservar a fauna brasileira diante do tráfico de animais silvestres do Brasil. Em suma, a pesquisa pretende identificar quais os principais fatores que levam ao comércio ilegal de fauna silvestre, analisando as diretrizes da legislação ambiental federal para coibir ou minimizar o tráfico de animais silvestres no Brasil, bem como avaliar a eficiência da legislação brasileira para a proteção da fauna silvestre. Para isso, o estudo baseou-se em pesquisa bibliográfica documental e pesquisa pelo método qualitativo de análise jurisprudencial no Superior Tribunal de Justiça, com intervalo entre os anos de 2015 e 2020.
The present study aims to analyze the Federal Government’s legislative measures and its effective duty to preserve the Brazilian fauna from wild animal trafficking in Brazil. In short, the research intends to identify the main factors that lead to the illegal wildlife trade, analyzing the guidelines of federal environmental legislation to restrain or minimize the trafficking of wild animals in Brazil, as well as evaluating the efficiency of Brazilian legislation for the protection of wild fauna. Thereunto, the study was based on documentary bibliographic research and research using the qualitative method of jurisprudential analysis in the Superior Court of Justice, with an interval between the years 2015 to 2020.
