Este artigo trata da questão dos fundamentos do Direito Internacional com base na análise das condições de validade dos tratados expressas pela Convenção de Viena sobre Direito dos Tratados de 1969. Argumenta-se existir a necessidade de se rediscutir os fundamentos deste direito, considerando a antinomia estrutural da disciplina. Para tanto, analisa os elementos que integram as condições de validade dos tratados pela Convenção de Viena, para caracterizar a coletividade internacional atual a fim de discutir as correntes teóricas sobre os fundamentos do Direito das Gentes. Conclui-se que, embora a Convenção de Viena revele a importância da vontade dos Estados na formação do Direito das Gentes, reconhece também, considerando o contexto sócio-histórico, a existência de valores essenciais nesta coletividade.
This paper deals with the issue of the foundations of International Law based on the analysis of the conditions for validity of the treaties expressed by the 1969 Vienna Convention of the Law of Treaties. It is argued that there is a necessity to rediscuss the Foundations of this Law, considering the structural antinomy of the discipline. For this purpose, it analyzes the elements that integrate the conditions of validity for the treaties by the Vienna Convention, to characterize the actual international collectivity in order to discuss the theoretical currents about the Law of Nations. It is concluded that, although the Vienna Convention reveals the importance of the will of States in the formation of the International Law, it also recognizes, considering the socio-historical context, the existence of essential values in this collectivity.
