Desenvolvido com base em pesquisas doutrinárias, o trabalho destina-se ao esclarecimento da questão relativa ao papel da Constituição nas teorias do jurista Hans Kelsen e do sociólogo Niklas Luhmann. Para tanto, será percorrido o contexto histórico no qual ambas as teorias foram elaboradas para, posteriormente, tentar descrever de forma clara e objetiva os principais pontos da Teoria Pura do Direito (Kelsen) e do Direito como Sistema Social (Luhmann). Assim, após a análise dos aspectos fundamentais das teorias desenvolvidas por ambos os autores, desenvolver-se-á um estudo específico acerca de como os mencionados pensadores enxergam a Constituição no contexto de suas teorias.

Developed based on doctrinal research, the work is intended to clarify the issue on the role of the Constitution in the theories of the jurist Hans Kelsen and the sociologist Niklas Lhumann. To this purpose, the historical context in which both theories have been elaborated will be traversed in order to later try to describe in a clear and objective way the main points of the Pure Theory of Law (Kelsen) and Law as Social System (Luhmann). Thus, after analyzing the fundamental aspects of the theories developed by both authors, a specific study will be developed about how the aforementioned thinkers see the Constitution in the context of their theories.
