O presente trabalho adota como referente uma análise dos tratados internacionais de nível mundial (Organização das Nações Unidas) e regional (Organização dos Estados Americanos) no que tange aos Direitos Humanos de caráter Econômico, Social e Cultural. Tendo como objetivo verificar a competência do sistema regional interamericano, composto pela Comissão Interamericana de Direitos Humanos e pela Corte Interamericana de Direitos Humanos, para a solução de litígios com estas características quando demandados por indivíduos. O presente trabalho se justifica na crescente necessidade de plena efetivação dos Direitos Humanos Sociais, dadas as desigualdades sócio-econômicas experienciadas em nosso continente e a unicidade afirmada pelos Direitos Humanos na sua consecução e evolução.

Resumo Inglês:

The present work has as referential the analysis of the international treaties as worldwide level (United Nations) and regional level (Organization of American States) on the matter of Human Rights concerning Economical, Social and Cultural Rights. Objecting to verify the competence of the American system, compound of the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, as a forum for solving this kind of matters when demanded by individuals. The present paper is justified in the growing need of Social Human Rights fulfillment, given the differences experienced in our continent and the unity of Human Rights for its effectiveness and applicability.
