O artigo examina, em seu início, o caso Marbury v. Madison e pontua a relação entre os poderes na época da histórica decisão. Trata da maneira pela qual as Cortes constitucionais funcionam a partir de três perspectivas distintas: a da coalizão, a estratégica e a interpretativa. Arrazoa sobre o papel dos Tribunais na elaboração de políticas públicas e aborda a possibilidade de formação de uma coalizão entre os poderes, como decorrência da indicação dos membros da Corte. Apresenta as críticas da teoria da escolha racional à coalizão e relata a perspectiva estratégica da Corte em sua interação com outros atores políticos. Estrutura, ainda, os questionamentos que a teoria institucional interpretativa fez à teoria dos jogos e evidencia os limites das duas teorias anteriores na análise do processo decisório.

The article examines first the case of Marbury v. Madison and punctuates the relationship between the powers at the time of the historic decision. It deals with the way constitutional courts function from three different perspectives: the coalition, the strategic and the interpretative. It discusses the role of the Courts in the elaboration of public policies and addresses the possibility of forming a coalition among the powers, as a result of the nomination of the members of the Court.
