CRÍTICA AOS LIMITES DO CONTROLE JURISDICIONAL DE POLÍTICAS PÚBLICAS EM DIREITOS SOCIAIS

A crescente demanda por soluções judiciais em questões relativas a políticas públicas sobre direitos sociais propicia ao Poder Judiciário a prerrogativa de implementar tais direitos coercitivamente. A comunidade jurídica, atenta a esse fenômeno, debruça esforços teóricos em busca de estabelecer limites a essa atuação, buscando resguardar o regime democrático e a separação de poderes. Este trabalho propõe-se à análise crítica dos limites até então propostos, à luz das causas políticas, necessidades sociais, e finalidades constitucionais da prestação jurisdicional de direitos sociais, e, reflexamente, da realização incidental de políticas públicas relativas a estes direitos pelo Judiciário.

Resumo Inglês:

The growing demand for judicial remedies in matters related to public policies on social rights gives the judiciary the authority to implement such rights coercively. The legal community, having regard to this phenomenon, examines theoretical efforts to establish limits to this action, seeking to safeguard the democratic system and separation of powers. This study aims to review the limits previously proposed in the light of political causes, social needs and purposes of constitutional adjudication of social rights and, reflexively, to the incidental completion of public policy by the judiciary.
