Cuando la justicia justifica la desintegración del espacio

In the present work, one tries to show how use of the justice is made to
disintegrate the social space; the justice is exercised by means of the
access and use of the rights, which they are recognized and guaranteed in
Mexico, for his Constitution of 1910, and for his fidelity to the Universal
Declaration of the Human rights, of 1948. Nevertheless, the rights of the
man, as individual and as being social, are having a regression from the
structural reforms that the neoliberalism, impactando in the social
relations of production. The case of the woman, oldster and native, in the Saw of Veracruz, in
Mexico; it illustrates the absence of capacities and skills of the rural
population, to gain access and to exercise his rights as Mexican citizens.
The woman, oldster and native died on February 27, 2007; the cause of
his death, officially one owed one " gastritis sharp "; extraofficially, for a
supposed tumultuous violation carried out by elements of the Mexican
army. The case of missis Ascencio, it illustrates the power that there
possesses the State, the flexibility of the justice and the vulnerable
condition of the population.

Resumo Espanhol:

En el presente trabajo, se pretende mostrar cómo se hace uso de la
justicia para desintegrar el espacio social; la justicia se ejerce mediante el
acceso y uso de los derechos, los cuales están reconocidos y garantizados
en México, por su Constitución de 1910, y por su apego a la Declaración
Universal de los Derechos Humanos, de 1948. Sin embargo, los derechos
del hombre, como individuo y como ser social, están teniendo un
retroceso a partir de las reformas estructurales que el neoliberalismo
promueve, impactando en las relaciones sociales de producción.
El caso de la mujer, anciana e indígena, en la Sierra de Veracruz, en
México; ilustra la falta de capacidades y habilidades de la población rural,
para acceder y ejercer sus derechos como ciudadanos mexicanos. La
mujer, anciana e indígena falleció el día 27 de febrero del 2007; la causa
de su muerte, oficialmente se debió a una “gastritis aguda”;
extraoficialmente, por una presunta violación tumultuaria efectuada por
elementos del ejército mexicano. El caso de la señora Ascencio, ilustra el
poder que posee el Estado, la flexibilidad de la justicia y la condición
vulnerable de la población.
