O presente trabalho traz uma análise da nova redação dada ao texto do § 6º do art. 226, da Carta Maior, a fi m de que se conclua se tal alteração levou ou não à extinção da separação judicial. Deste modo, são confrontadas as principais teses sustentadas pela doutrina, bem como recentes jurisprudências acerca do tema.

This paper presents an analysis of the new wording to the text of § 6 of art. 226, the Carta Maior, so it is clear whether or not this change led to the extinction of judicial separation. Th us, the main theses are faced sustained by the doctrine, as well as recent case law on the subject.
