O artigo tem por finalidade apresentar reflexões sobre os desafios enfrentados pelos atores do cenário processual ao utilizarem os procedimentos que resultam na formação e aplicação dos paradigmas decisórios (obrigatórios), extraídos dos julgamentos de casos repetitivos. Tendo por fundamento a necessária observância das garantias fundamentais do processo, o trabalho procura demonstrar que a legitimidade da atividade jurisdicional objetiva deve sempre estar associada aos contornos constitucionais do processo, e a decisão fixadora da tese vinculativa deve ser construída a partir de ampla participação dos interessados e apresentar fundamentação jurídica qualificada.
Resumo Inglês:
The article aims to present reflections on the challenges faced by the actors of the procedural scenario when using the procedures that result in the formation and application of the (mandatory) decision paradigms, extracted from the repetitive case judgments. Based on the necessary observance of the fundamental guarantees of the process, the work seeks to demonstrate that the legitimacy of the objective judicial activity must always be associated with the constitutional contours of the process and the decision that establishes the binding thesis must be built based on the wide participation of interested parties and present a qualified legal basis.
