The theories of legal argumentation, globalization in the legal field and the consolidation of constitutional jurisdictions have promoted the progressive centrality of jurisprudence in our days, thanks to the leading role recognized in the judicial function. Jurisprudence, judicial precedents and legal doctrine are concepts that although they are closely related concepts, do not mean the same nor do they entail the same degree of connection for the judge. If we add to this the confusion that results from using concepts in the continental system to which we give the meaning it has in the Anglo-Saxon system, the situation of confusion increases. In this work we will pay special attention to the doctrine of the judicial precedent. The approach of civil law to common law, the distinction between precedent, jurisprudence and legal doctrine will be analyzed. The doctrine of precedents will be examined in various contexts such as in the Spanish Constitutional Court, in Mexico and in Brazil, paying special attention to the universality of precedents and mandatory precedents, which raises questions as to whether independence will not be invaded of the judge.

Resumo Espanhol:

Las teorías de la argumentación jurídica, la globalización en el ámbito jurídico y el afianzamiento de las jurisdicciones constitucionales han impulsado en nuestros días la progresiva centralidad de la jurisprudencia, gracias al rol protagónico reconocido a la función judicial. La jurisprudencia, los precedentes judiciales y la doctrina legal son conceptos que aunque estén ellos conceptos estrechamente relacionados, no significan lo mismo ni conllevan el mismo grado de vinculación para el juzgador. Si a esto añadimos la confusión que se produce por el hecho de utilizar en el sistema continental conceptos a los que damos el significado que tiene en el sistema anglosajón, la situación de confusión se incrementa. En este trabajo prestaremos especial atención a la doctrina del precedente judicial. Se analizará la aproximación del civil law al commonlaw, la distinción entre precedente, jurisprudencia y doctrina legal. Se examinará ladoctrina de los precedentes en diversos contextostales como en el Tribunal Constitucional español, en México y en Brasil, prestando especial atención a la universalidad de los precedentes y a los precedentes obligatorios, lo que lleva a cuestionarse si no se estará invadiendo la independencia del juzgador.
