Democracy is a fundamental part of human rights, in its substantive aspect it represents rights such as freedom of expression, freedom of assembly or association, freedom of the press, right to information, non-discrimination, the right to
education, health, to the dignified life, to obtain the minimum vital, among others, in its formal or instrumental aspect the access and permanence in the public power, the right to vote, to be voted, to the political grouping, essentially, both facets they are the structure of any democratic system, but even before this accumulation of rights, the public organs of the States must respect the limits imposed in their decisions and policies, in order not to become dictatorships that subject the minorities or violate human rights, by having the obligation to remove subjects from the forbidden political agenda or submit their determination to majorities through direct participation mechanisms. The main source of restrictions on democratic regimes in the exercise of power are human rights from a conventional source.



Resumo Espanhol:

La democracia es parte fundamental de los derechos humanos, en su aspecto sustantivo representa los derechos como la libertad de expresión, libertad de reunión o asociación, libertad de prensa, derecho a la información, la no discriminación política, el derecho a la educación, a la salud, a la vida digna, a obtener el mínimo vital, entre otros, en su aspecto formal o instrumental el acceso y permanencia en el poder público, el derecho al voto, a ser votado, a la agrupación política, esencialmente, ambas facetas son la estructura de todo sistema democrático, pero aún ante este cúmulo de derechos, los órganos públicos de los Estados deben respetar los límites impuestos en sus decisiones y políticas, para no convertirse en dictaduras que sometan a las minorías ni vulneren derechos humanos, al tener la obligación de sustraer temas de la agenda política vedados ni someter su determinación a las mayorías por medio de mecanismos de participación directa. La fuente principal de las restricciones a los regímenes democráticos en el ejercicio del poder son los derechos humanos de fuente convencional.
