In this study, the theme that will be discussed is the “watergovernance” related to as an object of the principle of sovereignty applied in the sustainable and integrated management of hydric resources. Some aspects of both European and Brazilian juridical systems are highlighted, as to the social participation and information mechanisms. In other aspect, the water issue is brought up, in the perspective of Administrative and Environmental Law, being analyzed, on one hand, the confrontment of economic and environmental problems, and, on the other hand, administrative issues, specifically, the police functions and the public service. In the end, are highlighted the challenges of water governance in two current trends around the fundamental right to the access to everybody and about water’s economic value.
Resumo Espanhol:
En este estudio se va a tratar del tema de la gobernanza del agua como punto clave de la soberanía en la gestión sostenible de los recursos hídricos integrados, matizando unos aspectos del sistema jurídico europeo y brasileño respeto a participación e información. En otro aspecto, se centra en la perspectiva administrativa y medio ambiental, abordando más específicamente el tema del derecho de agua, ante los problemas más comunes afrontados en dos aspectos lo económico-ambiental y de cuestiones administrativas (función de policía y de servicio público). Por último, se destaca los retos de la gobernanza del agua en dos tendencias relevantes: el derecho fundamental del acceso al agua para todos, y sobre el valor económico del agua.
